Navigating a separation can be challenging for the whole family, particularly for any children involved. We understand that as parents, you always have your children’s best interests at heart, and we are here to support you in making arrangements that work for the whole family.
Where possible, it is usually preferrable to resolve matters without Court involvement. This can often promote a better co-parenting relationship between the parties, leading to better outcomes for the whole family in the long-term.
However, this is not always possible, especially in cases where there are allegations of domestic abuse, or there are urgent safeguarding issues to be addressed.
If matters cannot be resolved between the parties, a Court application may need to be made.
Before a Court application can be made, the applicant is required to attend a mediation information and assessment meeting (MIAM) with a mediator to discuss whether mediation could be suitable for the matter. If mediation is deemed to be unsuitable, or either party wishes not to proceed with mediation, the Court application can be made. There are exemptions to the MIAM requirement, and your family lawyer will discuss whether any of these may apply to your case.
An application is made via a C100 form, which sets out the details of the parties in the case, the orders the applicant would like the Court to make, and why the applicant would like them to be made. When the Court receives the application, they will invite the parties to a First Hearing Dispute Resolution Appointment (FHDRA).
A copy of the application and information relating to the FHDRA must usually be served upon the other party in the case (the respondent) to allow them to prepare a response. The respondent must usually confirm to the Court that they have received these documents.
At this hearing, the Court investigates the issues and enquires regarding the possibility of an agreement. If agreement cannot be reached, the Court will identify the outstanding issues and will direct how the case should proceed. The Court might order that a Cafcass (Children and Families Court Advisory and Support Service) officer prepares a report to help the judge at the Final Hearing, or it might order that the child be legally represented in the proceedings. An order may be made for the parties involved to prepare written statements of the evidence that they want the Court to hear. Sometimes the Court will adjourn the case for mediation to take place.
If the issues can’t be sorted out, the Court will ultimately hold further hearings and eventually, a Final Hearing. At that stage a judge will hear evidence from the adults involved, the Cafcass officer, and any other necessary experts, and then make a decision.

Once you have instructed us to handle your matter, we will provide you with our letter of engagement and terms of business. These documents explain how we will provide our services and explain how costs are incurred.
Following our instruction, we will provide you with an initial information note, setting out the information discussed in your initial consultation, our preliminary advice, and any pressing first steps to be made.
