If negotiations through parties, or solicitors are unsuccessful there are other options to consider prior to issuing a Court application. Before a Court application is made consideration should be given to alternative methods of reaching an agreement. Such methods can include mediation or arbitration if both parties are open to this.
If negotiations are unsuccessful, you may wish to make a Court application under TOLATA. The application will set out what your position is and what you are asking the Court to decide.
Once proceedings are issued, there are three main stages: disclosure, inspection, and evidence.
Disclosure is an ongoing obligation on both parties by which relevant documents that are, or have been, in your possession must be disclosed. This includes those that support and adversely affect your case.
There may be interim hearings throughout the process where temporary orders may be made. These orders may include directions to ensure that all evidence required has been obtained, and to ensure the matter is progressing.
At a Final Hearing, if matters have still not been agreed, the Court will be able to make a decision upon the application before them.

Once you have instructed us to handle your matter, we will provide you with our letter of engagement and terms of business. These documents explain how we will provide our services and explain how costs are incurred.
Following our instruction, we will provide you with an initial information note, setting out the information discussed in your initial consultation, our preliminary advice, and any pressing first steps to be made.

If you instruct us to do so, we will assist with the implementation of any Final Orders/ agreements. Upon conclusion of your case, your file will be closed in accordance with our File Storage policy.
